Terms of Use

Welcome to Loomshot. These Terms of Use (“Terms”) govern your access to and use of the Loomshot mobile application (“App”), website, and related services (collectively, the “Service”) operated by Proscendia (“Company,” “we,” “us,” or “our”).

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years of age to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. We reserve the right to request proof of age or parental consent at any time.

2. Account Registration

To access certain features, you must create an account using Sign in with Apple, Google Sign-In, or email registration. You agree to:

  • Provide accurate and complete information during registration.
  • Keep your account credentials secure and confidential.
  • Notify us immediately of any unauthorized access to your account.
  • Accept responsibility for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Subscriptions and Payments

3.1 Subscription Plans

Loomshot offers auto-renewable subscription plans that provide access to premium features, including AI-powered image generation, video creation, and an AI companion. Current plans include:

  • Loomshot Pro — Monthly ($9.99/month) or Annual ($107.99/year)
  • Loomshot Pro Max — Monthly ($29.99/month) or Annual ($324.99/year)

Prices are in USD and may vary by region. Actual pricing is displayed in the App at the time of purchase and is determined by the Apple App Store.

3.2 Free Trials

Certain subscription plans may include a free trial period. If you do not cancel before the free trial ends, your subscription will automatically convert to a paid subscription and you will be charged the applicable subscription price. Any unused portion of a free trial period will be forfeited when you purchase a subscription to the same subscription group.

3.3 Billing and Renewal

  • Payment will be charged to your Apple ID account at the confirmation of purchase.
  • Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.
  • You can manage and turn off auto-renewal by going to your Account Settings in the App Store after purchase.

3.4 Cancellation and Refunds

You may cancel your subscription at any time through your Apple ID Account Settings. Cancellation takes effect at the end of the current billing period — you will retain access to premium features until then. Refund requests are handled by Apple in accordance with their refund policy.

4. Acceptable Use

You agree not to use the Service to:

  • Generate, upload, or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, or otherwise objectionable.
  • Create content that infringes on intellectual property rights of any third party.
  • Generate deepfakes, non-consensual intimate imagery, or content depicting real individuals without their consent.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Attempt to circumvent content safety filters or generate prohibited content.
  • Use the Service for any fraudulent, deceptive, or illegal purpose.
  • Interfere with or disrupt the Service, servers, or networks connected to the Service.
  • Reverse engineer, decompile, or disassemble any portion of the Service.
  • Use automated systems (bots, scrapers) to access the Service.

We reserve the right to remove content and suspend or terminate accounts that violate this policy, at our sole discretion and without prior notice.

5. AI-Generated Content

5.1 Nature of AI Content

The Service uses artificial intelligence models provided by third-party providers (including Google Gemini and other AI services) to generate images, videos, and text. AI-generated content may not always be accurate, appropriate, or free from errors. You acknowledge that:

  • AI outputs are generated algorithmically and do not represent the views of Loomshot or its affiliates.
  • We do not guarantee the accuracy, completeness, or suitability of any AI-generated content.
  • You are solely responsible for reviewing and using AI-generated content appropriately.

5.2 Content Ownership

Subject to these Terms, you retain ownership of the original content you create using the Service. However, you grant Loomshot a non-exclusive, worldwide, royalty-free license to use, reproduce, and display your content solely for the purpose of operating and improving the Service.

5.3 Third-Party AI Data Processing

When you use AI-powered features, your input data (such as text prompts and uploaded images) may be sent to third-party AI service providers for processing. We will clearly identify these providers within the App and obtain your explicit consent before transmitting any personal data. See our Privacy Policy for details on how your data is handled.

6. User Content and Conduct

You are solely responsible for any content you create, upload, or share through the Service (“User Content”). By submitting User Content, you represent and warrant that you own or have the necessary rights to use and share the content, that it does not violate any applicable laws or third-party rights, and that it complies with the Acceptable Use provisions above.

We may review, moderate, or remove User Content at any time without notice if we believe it violates these Terms or applicable law.

7. Intellectual Property

The Service, including its design, features, code, graphics, logos, and trademarks, is owned by Proscendia and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and share your personal information.

9. Third-Party Services

The Service may integrate with or contain links to third-party services, including but not limited to Apple, Google, and AI service providers. We are not responsible for the content, privacy practices, or availability of third-party services.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PROSCENDIA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Proscendia from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Service, your User Content, or your violation of these Terms.

13. Account Deletion

You may request deletion of your account at any time through the App’s profile settings. Upon account deletion, your personal data will be permanently deleted within 30 days (except where retention is required by law), your User Content will be removed, and if you used Sign in with Apple, your Apple ID token will be revoked. Active subscriptions must be cancelled separately through the App Store.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately.

15. Governing Law

These Terms shall be governed by the laws of the State of Delaware, United States, without regard to its conflict of law principles.

16. General Provisions

  • Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Proscendia regarding the Service.
  • Severability: If any provision is found unenforceable, the remaining provisions continue in full force.
  • Waiver: Our failure to enforce any right shall not constitute a waiver.
  • Assignment: You may not assign these Terms without our written consent.
  • Modifications: We may update these Terms from time to time. Material changes will be communicated through the App or by email.
